Terms and Conditions for Location-Based Services
Article 1 (Purpose) The purpose of these Terms and Conditions is to define the rights, obligations, and responsibilities of Hugo Dynamics Co., Ltd. (hereinafter referred to as the "Company") and the users (hereinafter referred to as the "Member") in using the product-linked application services (hereinafter referred to as the "Service") provided by the Company. Article 2 (Effectiveness and Amendment of Terms) 1. These Terms shall take effect when a customer or personal location information subject who has applied for the Service agrees to these Terms and registers as a user of the Service according to the procedures prescribed by the Company. 2. The Company may amend these Terms to reflect changes in laws or the Service. In the event of an amendment, the Company shall announce the effective date and reasons for the amendment along with the current Terms on the initial screen of the Service or its website at least 7 days prior to the effective date. 3. However, in the case of changes unfavorable to the Member, the Company shall announce them at least 30 days in advance and individually notify the Member via email, app push notifications, etc. 4. If a Member does not agree to the amended Terms, they may stop using the Service and terminate the use contract. If a Member continues to use the Service after the announcement of the amendment without explicitly expressing refusal, they shall be deemed to have agreed to the amended Terms. Article 3 (Rules Other Than the Terms) These Terms shall be applied fairly in accordance with the principle of good faith. Matters not specified in these Terms shall be governed by the 「Act on the Protection and Use of Location Information」, 「Personal Information Protection Act」, 「Telecommunications Business Act」, 「Act on Promotion of Information and Communications Network Utilization and Information Protection」, and other related laws and detailed usage guidelines of the Service set by the Company. Article 4 (Contents of the Service) The contents of the location-based services provided by the Company are as follows. 1. Product Location Tracking Service: A service that collects location information of the Member's mobile terminal or the Company's products to display or guide the current location and movement paths on the app map. 2. Surrounding Information Service: A service that provides information on nearby related facilities, AS (After-sales) centers, etc., based on the Member's current location. 3. Other Services: 1) Connection of Company products (robotic prostheses, etc.) using Bluetooth. 2) Checking device status information (battery level, operation mode, etc.). 3) Changing device settings and switching modes. 4) Checking connection status and device error information. 5) Device error analysis. Article 5 (Service Fees) 1. The location-based services provided by the Company are basically free of charge. 2. However, data communication fees incurred when using wireless services shall be borne by the Member in accordance with the policies of the mobile carrier. 3. If separate paid services are included, the Company shall announce the details in advance and obtain the Member's consent. Article 6 (Collection and Use of Personal Location Information) 1. The Company collects location information using GPS, Wi-Fi, Bluetooth, and base station information of the terminal after obtaining the Member's consent to provide the Service. 2. When collecting personal location information, the Company shall clearly notify the Member of the following matters and obtain explicit consent: 1) Purpose of collection, use, and provision of location information. 2) Specific items of location information collected and methods of collection. 3) Retention and use period of location information. 4) Scope of third parties to whom location information is provided and the purpose of provision. 5) The right to refuse consent and the consequences of such refusal. 6) Rights of the personal location information subject and how to exercise them. 3. The Company must obtain separate consent for each item when receiving the consent mentioned in Paragraph 2, and Members may selectively agree to only some items. 4. The Company shall not collect or use personal location information beyond the scope consented to by the Member. If it exceeds the scope, the Company must obtain additional consent. 5. The Company collects only the minimum information necessary to achieve the purpose of location information collection. 6. Once the purpose of the Service is achieved, the Company shall immediately destroy the location information. However, if preservation is required by relevant laws, it shall be stored for the period specified by the law. 7. The Company shall take the following measures to prevent the leakage, alteration, or damage of location information. 1) Administrative Protective Measures a. Minimizing the number of employees handling location information and conducting regular training. b. Management and control of access authority for employees handling location information. c. Establishment and implementation of an internal management plan for the protection of location information. d. Enactment and operation of guidelines for the handling and management of location information. e. Designation and management of persons with access authority. 2) Technical Protective Measures a. Encrypted storage and transmission of location information. b. Access control and restriction of access authority for location information. c. Installation and periodic inspection of security programs to prevent location information security incidents. d. Installation and operation of firewalls. e. Security measures for the secure storage and transmission of location information. f. Preservation of location information access records and measures to prevent forgery or alteration. 8. The Company shall ensure that confirmation data regarding the collection, use, and provision of location information is automatically recorded and preserved in the location information system, and that such data includes the following items. 1) Date and time of collection, use, and provision of location information 2) Recipient of the location information 3) Purpose of using the location information 4) Identification information of the location information subject 9. The Company shall preserve the confirmation data referred to in Paragraph 8 for one (1) year and shall take technical measures to prevent forgery or alteration during the preservation period. Article 7 (Provision of Personal Location Information to Third Parties and Notification) 1. The Company shall not provide personal location information to a third party without the Member's prior explicit consent, except as required by law. 1) The recipient of the personal location information 2) The purpose of use by the recipient of the personal location information 3) The items of personal location information to be provided 4) The period of retention and use by the recipient of the personal location information 5) The right to refuse consent and the details of any disadvantages resulting from such refusal 2. When providing personal location information to a third party designated by the Member, the Company shall immediately notify the Member of the recipient, date/time, and purpose through the communication terminal that collected the information. 3. However, in any of the following cases, the Company shall notify the Member through a communication terminal or email address pre-specified by the Member. 1) Where the communication terminal from which the personal location information was collected does not have the function to receive text, voice, or video. 2) Where the Member has requested in advance to be notified by means such as online posting. 4. If the Company has obtained the Member's consent, the notification referred to in Paragraph 2 may be aggregated and sent periodically, at least once a month. 5. The Company shall not provide personal location information to a third party without the Member's consent, except in the following cases 1) Where there are special provisions in the law. 2) Where there is an emergency rescue request from an emergency rescue agency. 3) Where there is a legal request from a police station. 6. The Company shall not provide personal location information to a third party beyond the scope of consent obtained under Paragraph 1. If the Company intends to exceed the scope of the original consent, it must obtain additional consent from the Member. Article 8 (Rights of the Personal Location Information Subject) 1. A Member may withdraw all or part of their consent for the collection, use, or provision of personal location information at any time. 2. A Member may request temporary suspension of the collection, use, or provision of personal location information at any time. 3. A Member may request the Company to provide access to or notify them of the following data and may request correction if there are errors in such data. 1) Data confirming the collection, use, and provision of location information regarding the Member. 2) The reasons and details regarding the provision of the Member's personal location information to a third party. 3) History of the collection, use, and provision of the Member's personal location information. 4. Upon receiving a request to exercise rights under Paragraph 4, the Company shall take necessary measures without delay and notify the Member of the results within 7days at the latest from the date of receiving the request. 6. If a Member withdraws all or part of their consent, the Company shall immediately destroy the collected personal location information and the data confirming its collection, use, and provision. However, in the following cases, such data shall be stored for the specified period. 1) Data confirming the collection, use, and provision of location information pursuant to Article 16, Paragraph 2 of the 「Act on the Protection and Use of Location Information」: 1year 2) Cases where preservation is required by other laws and regulations: The period prescribed by the relevant law. 7. If a Member makes a request through a representative to exercise their rights, the Company may require documents proving the authority of representation to verify the representative relationship. 8. The Company may refuse such a request if exercising the Member's rights is likely to harm the life or body of another person or unfairly infringe upon another person's property or other interests; in such cases, the Company shall notify the Member of the reason for refusal. Article 9 (Rights of Legal Guardians for Children Under 14 and Protected Persons) 1. If the Company intends to use or provide personal location information of a child under the age of 14 (including services provided to a third party designated by the personal location information subject), it must obtain the consent of their legal guardian. 2. The Company shall deem that the subject has consented if the protector of a person falling under any of the following categories (hereinafter referred to as "Children Aged 8 or Under, etc.") consents to the use or provision of personal location information for the protection of the life or body of the Children Aged 8 or Under, etc. 1) A child aged 8 or under. 2) An adult ward (person under adult guardianship). 3) A person with a mental disability under Article 2, Paragraph 2, Item 2 of the 「Act on Welfare of Persons with Disabilities」 who also qualifies as a person with a severe disability under Article 2, Item 2 of the 「Act on Employment Promotion and Vocational Rehabilitation for Persons with Disabilities」 3. A protector who wishes to consent to the use or provision of personal location information for the protection of the life or body of Children Aged 8 or Under, etc., shall submit a written consent form to the Company along with a document proving their status as a protector. 4. The Company shall use the following methods to verify the consent of the legal guardian of a child under the age of 14. 1) Identity verification via the legal guardian's mobile phone. 2) Credit card authentication of the legal guardian. 3) Additional verification after email authentication of the legal guardian. 4) Submission and verification of a copy of the legal guardian's identification card. 5) Other methods recognized by the Korea Communications Commission. 5. Protectors of Children Aged 8 or Under, etc., may exercise all rights of the personal location information subject as stipulated in Article 8. 6. Even after obtaining the consent of the legal guardian or protector, the Company shall take special care in the collection, use, and provision of personal location information of children under 14 or Children Aged 8 or Under, etc., and shall take the following measures. 1) Strict restriction of access authority to the personal location information of children, etc. 2) Additional security measures when processing the personal location information of children, etc. 3) Regular notification of the status of information processing to the legal guardian or protector. 7. A legal guardian or protector may withdraw their consent for the collection, use, and provision of the personal location information of a child, etc., at any time, and the Company shall take necessary measures without delay. Article 10 (Designation of Location Information Manager) 1. The Company shall designate and operate a person in a position to take substantial responsibility as a Location Information Manager in order to appropriately manage and protect location information and smoothly handle complaints from personal location information subjects. 2. The name, affiliation, contact information, and email address of the Location Information Manager shall be disclosed through the Company's website (https://www.hugodmcs.com) and in-app notices, and any changes shall be announced without delay. 3. The Location Information Manager shall perform the following duties. 1) Establishing and implementing plans for the protection and management of location information. 2) Regular investigation and improvement of the status and practices of location information processing. 3) Handling complaints and providing relief for damages related to the processing of location information. 4) Establishing and operating an internal control system to prevent the leakage, misuse, and abuse of location information. 5) Establishing and implementing education plans for location information protection. 6) Inspecting compliance with laws and guidelines related to location information. 7) Responding to and reporting location information security incidents. 8) Supervising the implementation of technical and administrative measures for the protection of location information. 9) Other duties necessary for the protection of location information. 4. Members may report all civil complaints related to location information to the Location Information Manager, and the Company shall respond to the Member's reports promptly and faithfully. Article 11 (Prohibition of Leakage of Location Information) 1. The Company and its executives and employees shall not leak, alter, damage, or disclose location information learned in the course of their duties. 2. The obligation under Paragraph 1 shall continue even after the relevant executive or employee has retired or left the Company. 3. The Company shall conduct regular training for executives and employees regarding the obligation to protect location information and shall take strict disciplinary action in case of violation. 4. The Company shall take the following measures to prevent the leakage, alteration, or damage of location information. 1) Minimizing and strictly managing access authority to location information. 2) Preservation and regular inspection of location information access records. 3) Technical security measures to prevent leakage of location information. 4) Regular security checks on the location information processing system. 5. In the event of a location information leakage accident, the Company shall immediately take the following measures: 1) Immediate notification to the subjects of the leaked location information. 2) Reporting to the Korea Communications Commission. 3) Emergency measures to prevent additional leakage. 4) Investigation of the cause of the leakage and establishment of measures to prevent recurrence. Article 12 (Use of Personal Location Information for Emergency Rescue) 1. The Company may provide personal location information without the Member's consent if there is an emergency rescue request to protect life or physical safety from an emergency rescue agency or a police station pursuant to the 「Framework Act on the Management of Disasters and Safety」. 2. If the Company provides personal location information in accordance with Paragraph 1, it shall immediately notify the Member of such fact. However, if immediate notification is likely to cause a clear danger to the Member's life or body, the Company shall notify the Member without delay after such reason has ceased to exist. 3. The Company shall separately record and preserve the requests and details of personal location information provided to emergency rescue agencies or police stations and shall allow the Member to inspect them upon request. 4. The Company shall take necessary measures to ensure that personal location information provided for emergency rescue purposes is not used for purposes other than emergency rescue. Article 13 (Suspension and Modification of Service) 1. The Company may restrict or suspend all or part of the Service in any of the following cases. 1) In the event of maintenance, inspection, replacement, or failure of service equipment, or disruption of communication. 2) In the event that normal service use is hindered due to power failure, overall equipment failure, or a surge in usage volume. 3) In the event that the Service cannot be maintained due to the Company’s overall circumstances, such as termination of a contract with a service provider. 4) In the event that relevant laws and regulations, such as the 「Act on the Protection and Use of Location Information」, specifically prescribe it, or if relevant agencies, such as the Korea Communications Commission, order the suspension of the Service. 5) In the event of other force majeure reasons, such as natural disasters or national emergencies. 2. If the Company suspends the Service for the reasons set forth in Paragraph 1, it shall notify the Member in advance on the initial screen of the Service or its website. However, in the case of service suspension due to reasons beyond the Company's control, it may provide post-notification. 3. If the Company changes the contents of the Service, it shall announce the reasons for and details of the change on the initial screen of the Service or its website from 7 days prior to the effective date. However, in the case of changes unfavorable to the Member, the Company shall announce them from 30 days prior and provide individual notification via email, app push notifications, etc. 4. The Company shall not be liable for any damages incurred by the Member due to the suspension of the Service pursuant to Paragraph 1, unless there is intentional misconduct or gross negligence on the part of the Company. Article 14 (Obligations of the Member) 1. Members shall comply with relevant laws and regulations, the provisions of these Terms, usage guides, and precautions announced through the Service, and shall not engage in any other acts that interfere with the Company's business. 2. Members shall not engage in any of the following acts in connection with the use of the Service. 1) Collecting, using, or providing the location information of others without authorization. 2) Receiving location information by duplicating others' information and communication devices or stealing information. 3) Registering false information or stealing others' information. 4) Changing information posted by the Company without authorization. 5) Transmitting or posting information other than the information specified by the Company. 6) Infringing upon the intellectual property rights, such as copyrights, of the Company or a third party. 7) Damaging the reputation or interfering with the business of the Company or a third party. 8) Disclosing or posting obscene or violent messages, images, voices, or other information contrary to public order and morals on the Service. 9) Violating relevant laws and regulations, such as the 「Act on the Protection and Use of Location Information」. 3. If a Member violates Paragraph 2, the Company may take measures such as restricting the use of the Service or terminating the use contract for the relevant Member, and shall not be liable for any damages resulting therefrom. 4. If a Member causes damage to the Company or a third party by violating the obligations of this Article, the Member shall be responsible for compensating for such damage. Article 15 (Termination of Contract) 1. A Member may terminate the use contract at any time by withdrawing from the Service if they no longer wish to use the Service. 2. The Company may terminate the contract or restrict the use of the Service after prior notice if the Member falls under any of the following cases. However, notice may be omitted if it cannot be provided due to reasons attributable to the Member. 1) Using the location information of others without authorization. 2) Interfering with the stable operation of the Service. 3) Violating Article 14 (Obligations of the Member). 4) Violating relevant laws and regulations, such as the 「Act on the Protection and Use of Location Information」, or these Terms and Conditions. 5) Other cases where the Company deems it necessary to refuse the provision of the Service based on reasonable judgment. 3. When the Company terminates the contract, it shall notify the Member of the reason for termination via email, telephone, app push notifications, or other similar methods. 4. When a Member terminates the contract, all of the Member's data will be destroyed immediately upon termination, except in cases where the Company retains Member information in accordance with relevant laws and regulations or the Personal Information Processing Policy. 5. A Member may exercise their rights under Article 8 to check the history of collection, use, and provision of their location information before terminating the contract. Article 16 (Damages and Indemnification) 1. If a Member suffers damages because the Company violates the provisions of Articles 15 through 26 of the 「Act on the Protection and Use of Location Information」, the Member may claim damages against the Company. 2. In the case of Paragraph 1, the Company cannot be exempted from liability unless it proves that there was no intentional misconduct or negligence on its part. 3. If the Company suffers damages because a Member violates the provisions of these Terms and Conditions, the Company may claim damages against the Member. 4. The Company shall not be held liable for damages incurred by the Member if it is unable to provide the Service due to any of the following reasons. 1) In the event of natural disasters or equivalent force majeure states. 2) In the event of intentional service interference by a third party (such as a mobile carrier) that has entered into a partnership agreement with the Company for service provision. 3) In the event of a disruption in service use due to reasons attributable to the Member. 4) In the event of reasons other than those specified in items 1 through 3 where there is no intentional misconduct or negligence on the part of the Company. 5. The Company does not guarantee the reliability or accuracy of the Service or the location information, data, and facts posted on the Service, and shall not be held liable for any damages incurred by the Member therefrom, unless there is intentional misconduct or gross negligence on the part of the Company. 6. The Company’s liability for damages shall not exceed the usage fees paid by the Member to the Company for using the Service. However, this shall not apply in cases of intentional misconduct or gross negligence by the Company. Article 17 (Jurisdiction and Governing Law) 1. Any lawsuit regarding a dispute arising between the Company and a Member shall be filed with the competent court under the Civil Procedure Act. 2. The laws of the Republic of Korea shall apply to any lawsuit filed between the Company and a Member. (Effective Date) These Terms and Conditions shall take effect on January 2, 2026.
